Official Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW. OPEN ONLY TO UNITED STATES CITIZENS WHO LIVE IN THE 50 UNITED STATES OR THE DISTRICT OF COLUMBIA AND ARE 18 OR OLDER (19 IN ALABAMA AND NEBRASKA, 21 IN MISSISSIPPI). THESE RULES INCLUDE A BINDING INDIVIDUAL ARBITRATION AGREEMENT AND A WAIVER OF CLASS ACTIONS AND JURY TRIALS (SECTION 17).

1. No purchase necessary

MegaMoneySweeps (the “Site”) offers a continuing series of separate promotional sweepstakes and token games (together, the “Promotion”). Nothing on the Site is for sale. Entry is free, Tokens (section 7) cannot be bought, and the Sponsor does not accept payment of any kind from entrants. Every game and every prize can be entered and won without paying anyone anything. If anyone asks you to pay to enter, or to pay a fee to receive a prize, it is not the Sponsor: report it to [email protected].

2. Sponsor

The Promotion is sponsored and administered by MegaMoneySweeps, 3709 dicksonia dr, Suite 2, Lexington, KY USA 40517 (the “Sponsor”), a Kentucky company. The Promotion is not sponsored, endorsed or administered by, or associated with, any state lottery, Apple, Google, Meta, any advertiser or offer partner, or any company whose name, product or gift card appears as a prize. Those names identify the prize only. Amazon is not a sponsor of this promotion. Amazon.com Gift Cards are subject to restrictions, see amazon.com/gc-legal.

3. Agreement to these rules

By creating an account, entering, or playing any game, you agree to these Official Rules, the Terms of Use and the Privacy Policy, and to the decisions of the Sponsor, which are final and binding on every matter relating to the Promotion. These Official Rules control over any advertising, email, game screen or other description of the Promotion, and over the Terms of Use where the two conflict about the Promotion.

4. Eligibility

To enter or play, you must, at the time of every entry and play:

• be an individual human being acting for yourself, and not a bot, script, automated agent, business or anyone acting for another person;
• be a citizen of the United States living in the 50 United States or the District of Columbia;
• be 18 or older (19 in Alabama and Nebraska, 21 in Mississippi);
• have given only true, accurate and complete information to the Sponsor, including your legal name, date of birth and a valid, current residential street address where you live, and every answer you give to the optional member survey. You do not have to take the survey, but every answer you give in it must be truthful; and
• have complied with section 5, these Official Rules and the Terms of Use.

To win and be awarded any prize, you must also, before it is awarded, have confirmed the email address on your account and have a valid United States phone number at which you can be reached on your account, and still meet every requirement above.

One account per person. Where applicable law prohibits limiting eligibility by citizenship or immigration status, that limit does not apply to residents of that jurisdiction, who are eligible if they are legal residents and meet every other requirement. The Promotion is void where prohibited or restricted by law, and in any jurisdiction where it would require registration, bonding or a license the Sponsor has not obtained.

The Sponsor may verify any of these requirements at any time, and may require government-issued photo identification, proof of address, proof of citizenship and proof of age. If you do not provide what is requested within 10 days, or if the Sponsor cannot verify you to its satisfaction, you may be disqualified and your prizes and Tokens forfeited.

5. Automated play, ad blockers and prohibited conduct

You must play the Site yourself, by hand. You must not use, and must never have used while you hold an account:

• any bot, script, macro, crawler, automation tool, browser extension, emulator, device farm or other software or service that enters, plays, claims, watches, clicks, reads or otherwise uses the Site in place of you or faster than you could by hand; or
• any ad blocker, content blocker, browser setting or extension, DNS or network filter, or other software or service that blocks, hides, removes or alters the advertising on the Site. The advertising pays for the prizes. The Site may detect ad blocking and record it on your account.

You must also not:

• hold or use more than one account, use another person’s account, or let anyone else use yours;
• use a VPN, proxy or other means to disguise your identity or location, or use disposable or false email addresses or phone numbers;
• give false information, including false survey answers, or claim a prize for someone else;
• exploit any error, bug, malfunction or inconsistency in any game, offer, referral or reward, or fail to report one you have found;
• complete offers, referrals or rewarded videos fraudulently, in bulk, or on behalf of other people;
• sell, buy, transfer or trade accounts, Tokens, entries, plays or prizes;
• tamper with, interfere with or attempt to undermine the Site, the games or the Promotion, or act in a way the Sponsor considers abusive, threatening or disruptive to other members or to staff; or
• use profanity or obscene language toward, or abuse, harass, insult, intimidate or threaten, any employee, officer, director or contractor of the Sponsor, by email, message, phone call, review, social media post or any other means, whether on or off the Site.

If the Sponsor believes, in its sole discretion, that you have breached this section or any other part of these Official Rules, it may without notice void any or all of your entries, plays and results; remove your Tokens; disqualify you; refuse or withhold any prize, whether or not already approved; close your account; and bar you from the Site and any future promotion. You must repay the value of any prize paid to you while you were in breach within 30 days of the Sponsor asking. CAUTION: ANY ATTEMPT TO DAMAGE THE SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY VIOLATE CRIMINAL AND CIVIL LAWS. THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANYONE WHO MAKES SUCH AN ATTEMPT, TO THE FULLEST EXTENT PERMITTED BY LAW.

Instead of closing your account, the Sponsor may, in its sole discretion and without notice, restrict it, and need not tell you that it has done so. A restricted account can still be signed in to and used, and can still earn and spend Tokens, but it is not eligible to win any cash prize, any draw game prize other than Tokens, or any giveaway, or to be credited a cash gift or cash from offers. While an account is restricted: each instant game is played without its cash prizes, so a play that would otherwise win cash is settled from the same seed as the nearest play that does not, such as a blank card, a board without the cash pair, a Bubble Burst board without its cash bubbles, the cash in a box other than the one chosen, or a further draw of the numbers or the bounces from that seed, and a game in which every outcome is cash cannot be played; a draw game entry is not paid any cash prize it matches; its giveaway entries are not eligible entries; any prize it has won and not yet been paid or sent is withheld; and the Sponsor may send it no email other than one the account holder requests. The outcome of a restricted play is derived from its seed under these terms, so it can differ from the outcome the same seed would give an account that is not restricted. Tokens spent while an account is restricted, including on giveaway entries, are not refunded, and lifting a restriction does not change the outcome of any play made, or any draw or giveaway decided, while it applied.

In a dispute about who made an entry, the entry is made by the authorized account holder of the email address on the account at the time, meaning the person the email provider assigned that address to.

6. Promotion periods and how to take part

The Promotion began when the Site opened and continues until the Sponsor ends it by posting a notice on the Site. Each of the following is a separate sweepstakes with its own entry period:

• Daily Draws. Each draw game’s entry period for a game day runs from 12:00:00 a.m. to 11:59:59 p.m. Eastern Time, and its drawing takes place after the period closes, normally shortly after midnight. The Midday Draw is the exception: its entry period for a game day runs from 12:00:00 p.m. Eastern Time on the day before to 11:59:59 a.m. Eastern Time on that day, and its drawing takes place shortly after noon. An entry made after that time goes into the next day’s The Midday Draw. An entry counts only for the period in which it is received. A drawing that runs late for any reason is conducted as soon as practicable, from the result fixed when that period opened (section 10).
• Instant Games. Each round is its own sweepstakes and is resolved when it is played. Daily allowances reset at midnight Eastern Time.
• Token Games. The coin pusher and roulette are played with Tokens for as long as a member’s Token balance allows. A machine or table lasts for one game day.
• Giveaways. Each run of each giveaway is its own sweepstakes, entered with Tokens, and its closing date is shown on the giveaway. The Sponsor may extend a run’s entry period before it closes or when it closes, as many times as it chooses. Entries already made remain in that run’s drawing, and the new closing date is shown on the giveaway. Section 8 says what else may happen to a run with fewer than 100 different members in it.

To take part, create a free account, complete your profile and open a game. On a draw game you pick your numbers (on a card game, your cards) or use Quick Pick, which has exactly the same chance as numbers you choose. The free draw games allow one entry per member per game per entry period; token-entry draws cost the number of Tokens shown and allow the number of entries shown. Extra plays may be granted for confirming your email, completing the optional survey, check-ins, referrals, rewarded videos, articles, streaks, giveaway prizes, promotional emails and third-party offers. An extra play may be limited to the game it was offered on and to the day it was granted. An extra play offered by email is available once that day’s own play of the game has been used, and only for as long as the email says. Extra plays cannot be used on Daily Crossword, The Bonus Wheel, Coin Pusher or Roulette. A member who signs up from a promotional page that shows a line of numbers has that line entered in the named draw for the day they complete registration, in addition to their own daily entry. None of these requires a purchase. Some third-party offers involve signing up with or buying from a third party; no offer is ever required, and every game can be played and every prize won without completing one. The Sponsor sets and may change every allowance, limit and price; a draw keeps the game terms it opened with.

The Sponsor’s servers are the official clock and the official record of every entry, play, Token and result. An entry or play is made when the Sponsor’s servers record it, not when it is sent. Entries and plays that are late, incomplete, automated, duplicated, altered, or made by an ineligible person are void. The Sponsor is not responsible for entries or plays lost, delayed or garbled for any reason.

7. Tokens

• Tokens are promotional points with no cash or monetary value. They are not money, a deposit, a currency, property or a stored-value instrument, and they cannot be redeemed for cash. The Sponsor does not sell Tokens and never will.
• Tokens are earned free: 1 token for every round of every game, plus the other ways described on the Site. They can be used only to enter Token Games, token-entry draws and giveaways on the Site.
• Tokens cannot be sold, bought, transferred, gifted or combined between accounts. They are a limited, revocable license granted to you by the Sponsor, and the Sponsor may change how they are earned, what they cost to use, and what they can be used for, at any time.
• The Sponsor may remove Tokens credited in error, through a malfunction, through a breach of these rules, or for an offer the offer’s provider reverses or does not confirm, and may expire the Tokens on any account that has not been signed into for 12 months. All Tokens are forfeited, without compensation, when an account is closed or deleted for any reason.

8. Games, prizes and odds

Daily Draws

Each draw game draws its winning numbers from its pool. An entry wins the prize for the tier it matches. The prizes and exact odds for every draw game in the current lineup are:

Draw odds are the exact probability of matching that many numbers and do not depend on the number of entries received. There is no limit on the number of winners of a tier. Matching fewer numbers than the lowest tier wins nothing.

Lucky Deck displays the numbers 1 to 52 as a standard deck of playing cards. Every card is a number underneath: spades are 1 to 13, hearts 14 to 26, diamonds 27 to 39 and clubs 40 to 52, ace low in each. Choosing a card is choosing its number, and the drawing, matching, odds and verification in these Official Rules all apply to the numbers.

Instant Games and Token Games

The complete prize table and odds for each Instant Game and Token Game are stated on that game’s “How it works” card before you play, and form part of these Official Rules. The current lineup and each game’s top prize are:

• Token Drop: top prize 5,000 tokens, odds 1 in 455. 1 free play a day.
• Coin Pusher: top prize $10, odds 1 in 8,884. A Token Game, played with Tokens.
• Roulette: top prize 3,600 tokens, odds 1 in 38. A Token Game, played with Tokens.

Roulette pays Tokens only. Each coin pusher machine is loaded from its committed seed when the game day opens, the chance that a given prize is in a machine is stated on the game’s card, and whether a member works a prize out of the machine depends on how they play it. The Daily Crossword is decided by solving it, not by chance. For Match Two, the chance stated is the chance that a prize is on the board; finding it is up to the player.

In Bubble Burst, each level of a round is dealt from the round’s committed seed, and is dealt only once a computer solver has found a way to beat it; whether a member beats it depends on how they play it. A level is beaten when nothing left on the board can be burst and no more bubbles remain than the level allows, and its Tokens are awarded then. The chance stated for a bonus bubble is the chance that a level carries it, and its prize is awarded when the bubble carrying it is burst, whether or not that level is beaten. The first levels of each round are free; each further pair of levels is unlocked by watching a rewarded video, up to the number of videos the Site offers that day. A round ends when a level is finished without being beaten, when the member declines the video or no video is available, or when every level has been beaten, and levels beaten and bonuses burst before then are kept.

Giveaways

The prize, its approximate retail value, the Token cost of an entry and the closing date of each giveaway run are shown on the Redeem tokens page and form part of these Official Rules for that run. One winner is drawn at random from all eligible entries received in the run, each entry being one chance. The odds of winning depend on the number of eligible entries received. If the selected winner is ineligible, disqualified or does not claim the prize, it is forfeited and the Sponsor may, but need not, select another winner. If a run receives no eligible entries, no prize is awarded.

If fewer than 100 different eligible members have entered a giveaway run, the Sponsor may, in its sole discretion and for any run:

• extend the run’s entry period, when it closes or at any time before, by any length and as many times as it chooses;
• after the run has been drawn, and before its prize has been approved for delivery or sent, set that drawing aside and reopen the run for further entries. The entry that drawing selected does not win, and any award of the prize to it is cancelled. Any entries in a later run of the same giveaway that is open at the time are added to the reopened run, which closes no earlier than that later run would have, and a new drawing is held from all of the reopened run’s eligible entries when it closes; or
• void the run, in which case no prize is awarded for it and the Tokens each eligible member spent on entries in it are returned to that member’s balance.

An extended or reopened run keeps every entry already made in it and the seed fixed when it opened (section 10). An entry that cost no Tokens, such as one won in another game, is not replaced if its run is voided. The Sponsor currently extends automatically, by the run’s own length, any run whose prize is cash, a gift card or merchandise that closes with fewer than 100 different eligible members, and draws a run whose prize is extra plays or Tokens whatever the number of members in it. It may change either practice at any time.

Bonus prizes and promotions

The Sponsor may add bonus or promotional winnings to any game at any time, on top of whatever a play wins under the odds published for it. These include welcome bonuses for new members and seasonal or limited-time promotions, and the Sponsor may start, change or end any of them without notice. Bonus winnings are paid in the same way as other prizes, count towards the prize limits in these Official Rules, and are subject to every other condition here. They never change how a game is conducted: the outcome of the game itself is still fixed before play and published for checking as section 10 describes, and the published odds remain the odds of that game, except for an account restricted under section 5.

The one exception is the welcome round. While the Sponsor offers it, a member’s first play of the Daily Dollar draws the member’s own numbers back, in the order chosen, instead of drawing from a seed, and so pays the Daily Dollar prize. The game’s description says so on the page, that round has no seed to check, and every later play of the Daily Dollar is drawn and published as section 10 describes.

Cash gifts. The Sponsor may email a cash gift, currently $2.00, to a member who has not visited the Site for several days and whose winnings to date, cash winnings and giveaway prizes with a retail value of $1 or more together, not counting any that were refused, total less than the minimum payout less the gift, currently $13, so that a gift alone never reaches the minimum payout. Who is sent one, and when, is at the Sponsor’s discretion. The gift is credited to the member’s cash winnings when the member follows the link in that email while signed in to their account, at any time until the end of the day 7 days after the day the email was sent, Eastern Time, and is not credited after that. Each member may be credited one cash gift, ever. A cash gift is not a prize won in any game, is not shown on the winners page, and does not affect how any game is conducted or its odds. It is otherwise treated as cash winnings: it is claimed and paid as section 11 describes, counts towards the minimum payout, is forfeited on the same terms, and counts towards a winner’s prizes under section 12. An account restricted under section 5 is not credited a cash gift. The Sponsor may change the amount or end the offer at any time.

All prizes

• No single prize is worth $600 or more. The approximate retail value of a cash prize is its amount, of a gift card its face value, and of merchandise the value stated with it. Tokens and extra plays have no retail value.
• Prizes are awarded only to the eligible account holder, are not transferable, and cannot be substituted or exchanged for cash by the winner. The Sponsor may substitute a prize of equal or greater value for any reason. Merchandise and gift cards are provided as is, with only the manufacturer’s or issuer’s warranty, if any, and are subject to the issuer’s terms.
• The Sponsor may, in its sole discretion, award any gift card prize, of any brand, as a multi-option gift card of the same face value instead. A multi-option gift card is a credit for that value with a gift card partner the Sponsor chooses, which the winner exchanges on the partner’s site, under its terms, for the gift card or cards of their choice from the brands the partner offers at the time. Section 11 says how a cash prize may be paid in gift cards.
• Prizes, odds, balances and results shown on a screen or in an email are for information. The Sponsor’s records decide what was won.

9. Errors and malfunctions

MALFUNCTION VOIDS ALL PLAYS AND PAYS. If, because of any error or malfunction of software, hardware, network, data, display, seeding, printing or people, a game shows or records a result, prize, Token amount or win that is not the one its rules and seed produce, or more prizes are shown or awarded than the game provides, the Sponsor may void the affected entries, plays, results and prizes, correct any balance, and award only the prizes actually won under these Official Rules. The Sponsor is not required to award a prize shown or announced in error. Its determination is final.

10. How results are determined

Every draw, instant round, coin pusher machine, roulette table and giveaway run is decided by a computer process fixed before play. When it opens, the Sponsor generates a secret random value (the “seed”) and publishes only its SHA-256 hash (the “commitment”). The outcome is derived from the seed. When the draw, round, machine or run is over, the seed is published so that anyone can hash it, compare it with the commitment published beforehand, and derive the outcome again, under the terms in section 5 for an account that is restricted. The seed, commitment and a verification status are shown for completed draws on the results page, and How it works explains the check in plain language. Entries are scored automatically, and the result recorded by the Sponsor’s servers is final.

11. Winners, verification and payment

• Wins appear in your account after they are decided, and winners are listed on the winners page. The Sponsor need not tell you of a win by email or in any other way, and checking your account is your responsibility. If the Sponsor does send a notice, it is not responsible for one that is not received, is filtered as spam, or is not read.
• Before any prize is awarded, the Sponsor verifies eligibility and compliance with these Official Rules, and you must meet every requirement in section 4. The Sponsor may require a signed affidavit of eligibility, a liability and publicity release, a completed IRS Form W-9, and the documents described in section 4, each returned within 10 days of the request.
• Every cash prize, gift card and merchandise prize must be claimed from your account page before it is reviewed or sent: a cash prize by pressing Claim prize and saying on the claim page how you want to be paid, and a giveaway prize by pressing Claim prize beside it or, where it goes out with cash winnings, on the claim page with that cash. A giveaway prize can be claimed once your email address is confirmed, a phone number is on your account and the minimum payout below is met, and pressing Claim prize claims every giveaway prize of yours that can then go out. Tokens and extra plays are credited without a claim. A prize not claimed within 90 days of the day it could first be claimed is forfeited, unless the Sponsor, in its discretion, chooses to honor it.
• A payout can be requested once the member’s unpaid winnings total at least the minimum payout, currently $15, and the member’s email address is confirmed. Unpaid winnings are the member’s cash winnings, including cash gifts and cash earned from offers under the Terms of Use, not yet approved, paid or refused, together with each giveaway prize of theirs with a retail value of $1 or more not yet approved, sent or refused, so a gift card counts towards the minimum payout alongside cash. A request is for all of them and claims every such giveaway prize not yet claimed. A giveaway prize worth less than the minimum payout can be claimed only once the member’s unpaid winnings reach it. The request gives a valid phone number and the payment method the member wants for the cash; a giveaway prize is sent as described for it, or as section 8 allows. Smaller amounts are held and added to later winnings. Winnings that have not reached the minimum payout within 12 months of the earliest of them being won are forfeited.
• Cash prizes are paid by PayPal to the address you give, by check mailed to the address on your account, or as a gift card code sent by email, as offered on the claim page at the time, or by any other method the Sponsor chooses. Whichever method you ask for, the Sponsor may, in its sole discretion, pay any cash prize instead as a prepaid Visa, Mastercard or American Express gift card, as a multi-option gift card, or as a combination of them, with a total face value equal to the amount owed. Payment is normally made within 60 days after a prize is approved. No interest is paid. Fees charged to the recipient by a payment provider are the winner’s. A check not cashed within 90 days of being issued is void and is reissued only where the law requires. The Sponsor is not responsible for a payment sent to the details the winner gave, or for a check, code or prize lost, stolen or misused after it is sent.
• If the Sponsor suspects fraud, abuse, or a breach of these Official Rules or the Terms of Use in connection with your account, it may hold any prize or payment owed to you, whether or not already approved, for up to 365 days from the day it was claimed while it investigates. No interest is paid on a held prize. When the hold ends, the Sponsor pays or sends the prize, or refuses it under section 5.
• A prize that is declined, not claimed in time, returned as undeliverable, or awarded to someone who is ineligible or who cannot be verified is forfeited, and the Sponsor may award it to someone else or not at all.

12. Taxes

Winners are solely responsible for all federal, state and local taxes on every prize and for any other cost of accepting or using one. The Sponsor may require a completed Form W-9 before paying any prize, will issue an IRS Form 1099-MISC where a winner’s prizes in a calendar year total $600 or more, or where the law otherwise requires, counting cash earned from offers with them, and will withhold any tax the law requires it to withhold. The value of a prize for tax purposes is its approximate retail value as stated by the Sponsor.

13. Publicity and the winners list

Except where prohibited by law, by accepting a prize you grant the Sponsor the right to use your name, city and state of residence, likeness, voice, statements and prize information, in any media now known or later developed, worldwide and without time limit, for advertising, publicity and any other purpose, without further notice, compensation or approval. The Site currently publishes winners as first name, last initial and state, with the prize, on the winners page and in its emails to members.

For a list of winners for any completed entry period, email [email protected] or write to Winners List, MegaMoneySweeps, 3709 dicksonia dr, Suite 2, Lexington, KY USA 40517, naming the game and the date, within six months of the end of that period.

14. The Sponsor’s rights

The Sponsor may, at any time and in its sole discretion: interpret these Official Rules; add, change, suspend or retire any game, prize, allowance, limit, price, odds or promotion for the future; cancel, suspend or modify the Promotion or any part of it if fraud, technical failure, a virus, unauthorized intervention or any other cause affects its administration, security, fairness or proper operation, and in that event award prizes from among the eligible entries received before the event; and amend these Official Rules, for any reason and without notice. An amendment takes effect immediately when it is posted on this page, and the Sponsor may, in its sole discretion and to the fullest extent permitted by law, also apply it retroactively, including to accounts, Tokens, entries, plays, prizes and conduct from before it was posted. Taking part after an amendment is posted is acceptance of it. The date at the top of this page is when these Official Rules last changed, and it is your responsibility to check it each time you take part. Two things are never changed after the fact: a draw already open keeps the game terms it opened with, and an amendment to section 17, or to the arbitration section of the Terms of Use it incorporates, never applies to a dispute that arose before it was posted. The Sponsor’s failure to enforce any term is not a waiver of it.

15. Release, disclaimers and limitation of liability

By taking part, you release, discharge and hold harmless the Sponsor, its parents, affiliates, advertisers, offer and advertising partners, prize suppliers, payment providers, and each of their officers, directors, members, managers, employees, contractors and agents (the “Released Parties”) from every claim, liability, injury, loss or damage of any kind arising out of or relating to the Promotion, the Site, any Tokens, or the award, receipt, use or misuse of any prize, including claims based on publicity rights, defamation or invasion of privacy.

The Released Parties are not responsible for: incorrect or inaccurate information, whether caused by entrants, printing errors or any equipment or programming; technical failures of any kind, including malfunctions, interruptions or disconnections of networks, servers, software or devices; unauthorized human intervention in any part of the Promotion; errors in administering the Promotion or processing entries, plays or claims; or any injury or damage to any person’s device resulting from taking part.

THE PROMOTION, THE SITE AND EVERY PRIZE ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, THE RELEASED PARTIES ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, AND THEIR TOTAL LIABILITY TO YOU FOR ALL CLAIMS WILL NOT EXCEED THE VALUE OF ANY PRIZE YOU VALIDLY WON UNDER THESE OFFICIAL RULES AND WERE NOT PAID.

You will indemnify and hold harmless the Released Parties from any claim, loss or expense, including reasonable attorneys’ fees, arising out of your breach of these Official Rules or your taking part in the Promotion. Nothing in these Official Rules limits any liability that the law does not allow to be limited.

16. Governing law

These Official Rules and the Promotion are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs the arbitration agreement. All questions about the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and the Sponsor, are governed by Kentucky law.

17. Disputes: binding arbitration and class action waiver

ANY DISPUTE ARISING OUT OF OR RELATING TO THE PROMOTION, THESE OFFICIAL RULES OR ANY PRIZE WILL BE RESOLVED EXCLUSIVELY BY BINDING INDIVIDUAL ARBITRATION UNDER THE DISPUTE RESOLUTION SECTION OF THE TERMS OF USE, WHICH IS PART OF THESE OFFICIAL RULES. YOU AND THE SPONSOR EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO BRING OR TAKE PART IN ANY CLASS, COLLECTIVE OR REPRESENTATIVE ACTION.

To the fullest extent permitted by law: any remedy is limited to your actual out-of-pocket costs of taking part, and never attorneys’ fees; you waive any right to punitive, incidental, consequential or multiplied damages; and you waive any right to rescind these Official Rules or to seek an injunction or any other equitable relief against the Promotion.

18. Privacy

Information you give is collected by the Sponsor and used, shared and sold as described in the Privacy Policy, including to run the Promotion, verify eligibility, award prizes and advertise.

19. General

If any part of these Official Rules is held invalid or unenforceable, it is modified to the minimum extent needed to make it enforceable, or severed if it cannot be, and the rest remains in effect. Headings are for convenience only. These Official Rules, the Terms of Use and the Privacy Policy are the entire agreement about the Promotion. The Sponsor may assign its rights under them. The English version controls.
